applied for an order determining that Genia Maizlin (the 'Landlord') failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 (the 'Act') or failed to comply with health, safety, housing or maintenance standards. An Adjudicative Case Conference (‘ACC’) was held by videoconference on May 20, 2026. Only the Tenants, Maryam Motamedy (‘MM’) and Hamed Motamedi (‘HM’), attended the ACC. As of 10:48 a.m., the Landlord was not present or represented at the ACC although properly served with notice of this ACC by the LTB. There was no record of a request to adjourn the ACC. As a result, the application proceeded to an uncontested hearing with only the Tenants' evidence.
It is ordered that: 1. The Landlord shall pay the Tenants $628.81. This amount represents: • $580.81 for a rent abatement • $48.00 for the cost of filing the application. 2. The Landlord shall pay the Tenants the full amount owing by June 9, 2026. 3. If the Landlord does not pay the Tenants the full amount owing by June 9, 2026, the Landlord will owe interest. This will be simple interest calculated from June 10, 2026 at 4.00% annually on the balance outstanding.
