applied for an order determining that Todd Kluwak (the 'Landlord'): • substantially interfered with the reasonable enjoyment of the rental unit or residential complex by the Tenant or by a member of their household (T2 Application). • failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 (the 'Act') or failed to comply with health, safety, housing or maintenance standards (T6 Application). It is ordered that: 1. The total amount the Landlord shall pay the Tenant is $1,093.93. This amount represents: • $555.93 for a rent abatement. • $400.00 for the moving, storage or other like expenses that the Tenant has i ncurred • $90.00 for the reasonable out -of-pocket expenses the Tenant has incurred • $48.00 for the cost of filing the application. 2. The Landlord shall pay the Tenant the full amount owing by March 31, 2026. 3. If the Landlord does not pay the Tenant the full amount owing by March 31, 2026, the Landlord will owe interest. This will be simple interest calculated from April 1, 2026, at 4.00% annually on the balance outstanding. 4. If the Landlord does not pay the Tenant the full amount owing by April 1, 2026, the Tenant may recover this amount by deducting $1,094.23 from the rent due and owing for the month of April 2026. 5. The Tenant has the right, at any time, to collect the full amount owing or any balance outstanding under this order. 6. On or before April 30, 2026, the Landlord shall arrange for mold and asbestos testing with a qualified technician. Results of the testing shall be provided to the Tenant within 10 business days of their receipt and shall be provided to the Tenant no later than July 31, 2026, failing which the Tenant may make another application to the Board.
