applied for an order determining that Lindsay Wright (the 'Landlord') gave a notice of termination in bad faith. This application was scheduled to be heard by videoconference on May 5, 2026. The Tenant and was represented by Damian Cordaie. The Landlord’s Legal Representative, Carrie Aylwin, also participated. Before the start of the hearing the parties advised that they had reached an agreement. As a result of the resolution discussion, the parties mutually agreed to resolve all matters in the application and requested an Order on Consent. I was satisfied that the parties understood the terms and consequences of their consent. On consent of the parties,
it is ordered that: 1. The Landlord shall pay to the Tenant $10 000.00 on or before May 10, 2026. This amount shall be paid directly to the Tenant via e-transfer; 2. Simple Interest will be calculated (Courts of Justice Act) on any balance outstanding commencing May 11, 2026; 3. With the exception of the collection of any money that comes due as a result of this Order, then this Order settles all matters arising from this tenancy and neither party will file any other application, action, claim or commence any proceedings against the other party related to this tenancy in any court of competent jurisdiction.
