applied for an order to terminate the tenancy and evict Katherine Marcantognini (the 'Tenant') because the Tenant did not pay the rent that the Tenant owes.
It is ordered on consent that: 1. The tenancy between the Landlord and the Tenant is terminated and the Tenant must move out of the rental unit on or before June 30, 2026. 2. If the unit is not vacated on or before June 30, 2026, then starting July 1, 2026, the Landlord may file this order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced. 3. Upon receipt of this order, the Court Enforcement Office (Sheriff) is directed to give vacant possession of the unit to the Landlord on or after July 1, 2026. 4. The Landlord waives $13,500.00 which represents the outstanding rent arrears owing by the Tenant to March 31, 2026. 5. As of the hearing date, the amount of rent deposit and interest the Landlord owes on the rent deposit is $2,758.10. However, the Landlord is entitled to deduct from that amount $88.77 per day for the use of the unit starting April 1, 2026, until the date the Tenant moves out of the unit. 6. The Landlord and Tenant will pay to each other any money that is owing as a result of this order. 7. If the Tenant fails to pay the Landlord any money owing to the Landlord in accordance with paragraphs 5-6 of this order, the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 (the ‘Act') for an order terminating the tenancy and evicting the Tenant earlier than the agreed upon June 30, 2026.
