It is ordered that: 1. The motion to set aside Order LTB-L-101213-25, issued on December 8, 2025, is granted. 2. Order LTB-L-101213- 25, issued on December 8, 2025, is set aside and cannot be enforced. 3. The previous order issued on November 13, 2025 with respect to LTB-L-051443- 24 is cancelled and replaced by the terms set out below, based on the submissions of the parties at the hearing. 4. The Tenant shall refrain from the following conduct: a. Tampering with the structural integrity of the rental unit; b. Tampering with the electrical wiring and/or connections in the rental unit; c. Conducting any unapproved renovations/modifications in the rental unit; and, d. Blocking, disconnecting, or modifying the smoke detector in the rental unit. 5. The Landlord may conduct monthly inspections of the rental unit, provided notice is provided in accordance with the Act and in advance of the inspection and the Tenant shall not deny this entry. 6. If the Tenant fails to comply with paragraphs 4 and 5 of this order from April 21, 2026, to April 20, 2028, the Landlord may, without notice to the Tenant and within 30 days of the breach, apply to the Board pursuant to section 78 of the Act for an order terminating the tenancy and evicting the Tenant. 7. Prior to filing any application with the Landlord and Tenant Board in relation to any alleged breaches of this order, the Landlord shall notify the following parties of their intent to do so: a. The Tenant; b. Milton Forrester, the Tenant’s Mental Health Caseworker; and, c. Imbisat Chowdhary, the Tenant’s caseworker at the Scarborough Co...
