Dispute this orderapplied for an order to terminate the tenancy and evict Neli Khachapuridze (the 'Tenant') because: • the Tenant or another occupant of the rental unit has committed an illegal act or has carried out, or permitted someone to carry out an illegal trade, business or occupation in the rental unit or the residential complex. • the Tenant, another occupant of the rental unit or a person the Tenant permitted in the residential complex has seriously impaired the safety of any person and the act or omission occurred in the residential complex. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date. This application was heard by videoconference on February 11, 2026.
It is ordered that: 1.The tenancy between the Landlord and the Tenant continues if the Tenant meets the conditions set out below. Please note that the omission of a term/time limit is intentional, as these terms will not expire until the tenancy is terminated. 2.The Tenant shall not possess or store any firearm in the rental unit or within the residential complex. George Nareshelashvili (the son of the Teant who committed the assault) shall not be permitted in the rental unit or residential complex, unless written consent is provided by the Landlord. (emphasis added) 4. The Tenant shall submit to inspections of her rental unit monthly. The Landlord is reminded that proper notice, pursuant to section 27(1) of the Act is required prior to entry into the rental unit. The purpose of the inspection will be to confirm that the rental unit is free of firearms. 5. If the Tenant fails to comply with the conditions set out in paragraphs 2, 3, and 4 of this order, the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 (the ‘Act') for an order terminating the tenancy and evicting the Tenant. The Landlord must make the application within 30 days of a breach of a condition. This application is made to the LTB without notice to the Tenant. 6. The Tenant shall pay to the Landlord $186.00 for the cost of filing the application. 7.
