Dispute this orderapplied for an order requiring Khairulbanat Sadaat and Fazal Mohammad Khan (the 'Tenants') to pay the Landlord's reasonable out-of-pocket costs the Landlord has incurred or will incur to repair or replace undue damage to property. The damage was caused wilfully or negligently by the Tenants, another occupant of the rental unit or someone the Tenants permitted in the residential complex. This application was heard by videoconference on February 4, 2026.
It is ordered that: 1. The Landlord’s application for eviction of the Tenants is denied as long as the Tenants meet the conditions set out below: a. The Tenants must pay $2, 605.33 to the Landlord for the damages stemming from the above. This amount includes the $186.00 fee which the Landlords are entitled to receive. These payments are to be made as follows: b. The Tenants shall pay the Landlords the sum of $250.00 per month commencing March 15, 2026 and shall continue making that $250.00 payment to the Landlord for the months of April, May, June, July, August, September, October, November and December of 2026; c. The Tenants shall pay the Landlords the final sum of $105.33 on January 15, 2027 which will complete the Tenants’ payment for the above damages; and d. For clarity purposes, this monthly payment from the Tenants represents payment for the damage claim and this payment should be attributed to the Landlord’s successful claim of $2,605.33. If the Tenants fail to comply with any of the conditions in accordance with paragraph 1, the Landlord may apply under section 78 of the Act for an order terminating the tenancy and evicting the Tenants. The Landlord must make the application within 30 days of a breach of a condition set out in paragraph 1 of this order.
