It is ordered that: 1. The motion to set aside o rder LTB-L-088339- 25, issued on October 29, 2025, is granted. The order is set aside and cannot be enforced. 2. The Landlord’s L4 application contained in Board file LTB -L-088339- 25 is dismissed. 3. The previous order issued on September 25, 2025, with respect to the original application contained in Board file LTB-L-059768- 25 is amended pursuant to s. 78(12) of the Residential Tenancies Act, 2006 (the 'Act') by replacing it with the following: 1) The Tenant shall pay to the Landlord $4, 040.58 which represents the rent arrears owing for the period ending December 31, 2025, and the Landlord’s unrecoverable costs of filing the eviction order with the Sheriff. 2) The Tenant shall pay to the Landlord the amount set out in paragraph 1) above in accordance with the following schedule: a. $1,010.15 on or before the 1 st day of each month for the period January 1, 2026 to March 31, 2026; and b. $1,010.13 on or before April 1, 2026. 3) The Tenant shall also pay to the Landlord new rent on time and in full for the period January 1, 2026, to December 31, 2026. 4) If the Tenant fails to make any one of the payments in accordance with this order, the outstanding balance of any arrears of rent and costs to be paid by the Tenant to the Landlord pursuant to paragraph 1) of this order shall become immediately due and owing and the Landlord may, without notice to the Tenant, apply to the Board within 30 days of the Tenant’s breach pursuant to section 78 of the Act for an order terminating the tenancy and evicting the Tenant and requiring...
