Dispute this orderIt is ordered that: L2 application 1. The Landlords application to terminate the tenancy is denied, subject to the following conditions below. 2. For a period of twelve months from the date of this order, the Tenant Shahzali Samah shall not engage in any physical or threatening altercations towards the upper unit tenant KR, the Landlords, other tenants, guests, or occupants at the residential complex. 3. For a period of twelve months from the date of this order, The Tenant Shahzali Samah shall not have contact with the upper unit tenant KR at the residential complex, except for any incidental contact which may arise as a result that they both reside at the residential complex. 4. Effective immediately, the Tenants shall only run the fan in the bathroom for short periods of time when the bathroom is in use. The Tenants shall not run the bathroom fan in their rental unit for prolonged periods of time to deliberately create excess noise for the upper unit Tenant KR. 5. By April 7, 2026, the Landlords shall engage in a process of consultation with the Tenants and/or through the Tenants legal representative to come up with potential solutions to File Numbers: LTB-L-087542-24 LTB-T-096050-24 Order Page 25 of 26 accommodate the Tenants up to the point of undue hardship. The Tenants shall cooperatively engage in the process. 6. If the Tenants fail to comply with any of the conditions set out in paragraph 2, 3, 4, or 5 of this order, the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 (the ‘Act') for an order terminating the tenancy and evicting the Tenant...
