applied for an order to terminate the tenancy and evict Bonny Hoerner and David Kenny (the 'Tenants') because the Tenants did not pay the rent that the Tenants owe. This application was heard by videoconference on March 30, 2026.
It is ordered that: 1. The Tenants shall pay to the Landlord $2,094.90 for arrears of rent up to March 31, 2026 which includes the application fee of $186.00. 2. The Tenants shall pay the sum of $150.00 to the Landlord on the first of each month commencing April 1, 2026 and each month thereafter with the last $150.00 payment to be made on April 1, 2027. The final payment of $144.90 shall be paid by the Tenants on May 1, 2027 which will pay off the rental arrears of $2,094.90. 3. The Tenants shall also pay to the Landlord new rent on time and in full as it comes due and owing for the period April 1, 2026 to May 1, 2027 or until the arrears are paid in full, whichever date is earliest. 4. If the Tenants fail to make any one of the payments in accordance with this order, the outstanding balance of any arrears of rent and costs to be paid by the Tenants to the Landlord pursuant to paragraphs 1 - 3 of this order shall become File Number: LTB-L-006169- 26 Order Page 3 of 3 immediately due and owing. T he Landlord may, without notice to the Tenants, apply to the LTB within 30 days of the Tenants ’ breach pursuant to section 78 of the Act for an order terminating the tenancy and evicting the Tenants. The Landlord may also require that the Tenants pay any new arrears, NSF fees and related charges that became owing after March 31, 2026.
