Dispute this orderapplied for an order to terminate the tenancy and evict David Ben- Daniel and Isaac Ben- Daniel (the 'Tenants') and for an order to have the Tenants pay the rent they owe because the Tenants did not meet a condition specified in the order issued by the LTB on August 2, 2024, with respect to application LTB-L-047805-24. On September 6, 2024, an amended order was issued, LTB -L-047805- 24-AM which replaces LTB -L-047805-24. This application was decided without a hearing being held.
It is ordered that: 1. The tenancy between the Landlords and the Tenants is terminated. The Tenants must move out of the rental unit on or before September 20, 2024. 2. If the unit is not vacated on or before September 20, 2024, then starting September 21, 2024, the Landlords may file this order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced. 3. Upon receipt of this order, the Court Enforcement Office (Sheriff) is directed to give vacant possession of the unit to the Landlords on or after September 21, 2024. 4. The Tenants shall pay to the Landlords $20,179.04 (Less any payments made by the Tenants after this application was filed on August 16, 2024). This amount represents the rent owing up to September 9, 2024, and the cost of filing the previous application, less the rent deposit and interest the Landlords owe on the rent deposit. 5. The Tenants shall also pay to the Landlords $105.21 per day for compensation for the use of the unit starting September 10, 2024, to the date the Tenants move out of the unit. 6. If the Tenants do not pay the Landlords the full amount owing on or before September 20, 2024, the Tenants will start to owe interest. This will be a simple interest calculated from September 21, 2024, at 7.00% annually on the balance outstanding.
