applied for an order determining that the Landlord had failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 (the 'Act') or failed to comply with health, safety, housing or maintenance standards (the ‘T6 application’). These applications were heard together by way of a video conference on January 11, 2021. The Landlord attended the hearing. The Tenant Zack Malins-Bush (‘ZMB’) attended the hearing on behalf of the Tenants, along with the Tenants’ Agent, Patricia Bush.

It is ordered that: 1. The tenancy between the Landlord and the Tenants is terminated as of September 30, 2019, the date the Tenants gave vacant possession of the rental unit to the Landlord. The amount of $2,535.00 plus accrued interest shall be paid out to the Landlord. 2. The Tenants shall pay to the Landlord $1,115.43*, which represents the amount of rent owing and compensation up to September 30, 2019, less the rent deposit and interest the Landlord owes on the rent deposit. 3. The Tenants shall also pay to the Landlord $175.00 for the cost of filing the application. 4. If the Tenants do not pay the Landlord the full amount owing* on or before June 13, 2021, the Tenants will start to owe interest. This will be simple interest calculated from June 14, 2021 at 2.00% annually on the balance outstanding. 5. The Board shall pay to the Landlord the amount of $2,535.00 together with any accrued interest.
