Determinations

It is ordered that: 1. The Landlord’s application to evict the Tenant is denied subject to the following conditions: a) For a period of 12 consecutive months starting September 1, 2021, the Tenant shall allow the Landlord entry to the rental unit when given proper notice of entry by the Landlord. 2. If the Tenant fails to comply with any requirement set out in paragraph 1 of this order, the Landlord may apply under s.78 of the Residential Tenancies Act, 2006 within 30 days of the breach and without notice to the Tenant for an order terminating the tenancy and evicting the Tenants. 3. The Tenant shall pay to the Landlord $186.00 for the cost of filing the application. 4. If the Tenant does not pay the Landlord the full amount owing on or before August 29, 2021, the Tenant will start to owe interest. This will be simple interest calculated from August 30, 2021 at 2.00% annually on the balance outstanding.
