applied for an order determining that the Landlord collected or retained money illegally. (T1 application - LTB-T-109364-25). The Tenant also applied for a second order determining that the Landlord gave a notice of termination in bad faith. (T5 application - LTB-T-109386-25). Application LTB-T-109030-25 was scheduled for a merit hearing on April 21, 2026. The Tenant, the Landlord and the Landlord’s legal representative Dan Schofield attended the hearing. As explained below, the hearing was adjourned on consent of the parties, and this Interim order also addresses the other two related matters (LTB-T-109364-25 & LTB-T-109386-25).
It is ordered that: 1. Application LTB-T-109386-25 is withdrawn. Board staff are directed to cancel the hearing scheduled for May 20, 2026. 2. Applications LTB-T-109030-25 and LTB-T-109364-25 are adjourned to be heard together. The LTB will send the parties a Notice of Hearing for the next hearing date. 3. Board staff shall cancel the April 28, 2026 hearing date for LTB-T-109364-25. 4. The parties are directed to give to each other and to the LTB any evidence that relates to the application no later than seven days before the hearing. This includes any documents, receipts, photographs, recordings or like things the party intends to rely on at the hearing. 5. Parties may give disclosed material to the LTB by uploading the material to the Tribunals Ontario Portal (‘TOP'). Uploading material to TOP does not constitute disclosure to the other party unless the parties have agreed in writing to exchange documents via TOP. Pursuant to Rule 19.7 a party who fails to comply with an order for disclosure may not be permitted to rely on evidence that is not properly disclosed.
