applied for an order determining that the Landlord: • entered the rental unit illegally. • substantially interfered with the reasonable enjoyment of the rental unit or residential complex by the Tenant or by a member of their household. • harassed, obstructed, coerced, threatened or interfered with the Tenant. These applications were heard by videoconference on January 30, 2026. The first named Tenant, the Tenants’ legal representative, Chris Williams, the Landlord, and the Landlord’s representative, Shan Rajah attended the hearing.
It is ordered that: 1. The Landlord shall pay to the Tenants a rent abatement in the amount of $200.00 and since the Tenants are partially successful with the claims in their application the Landlord shall also pay the costs in the amount of $53.00. Therefore, the total abatement the Landlord owes the Tenants is $253.00. I have deducted that from the arrears the Tenants owe. 2. The Tenants shall give the Landlord a full copy of any utility bill that becomes due and owing, within 5 days of receiving it. 3. Within 5 days of the Tenants giving the Landlords the full copy of the utility bill, the Landlord shall remit their portion to the Tenants. 4. If the Landlord fails to comply with paragraph 3, above, than the Tenants may deduct the Landlord’s portion of the utilities owing from the monthly rent. Additionally, the Tenants in writing, shall set out to the Landlord which month they are deducting it from and the total amount they are deducting. 5. The tenancy between the Landlord and the Tenants is terminated unless the Tenant void this order. 6. The Tenants may void this order and continue the tenancy by paying to the Landlord or to the LTB in trust: File Numbers: LTB-L-051132-25 LTB-T-105948-24 Order Page 10 of 11 • $28,531.60 if the payment is made on or before April 30, 2026 (less any payments made by the Tenants).
