applied for an order determining that Mohammad Shafique (the 'Landlord') substantially interfered with the reasonable enjoyment of the rental unit or residential complex by the Tenant or by a member of their household and that the Landlord harassed, obstructed, coerced, threatened, or interfered with the Tenant (the ‘T2 Application’). The Tenant also applied for an order determining that the Landlord collected or retained money illegally (the ‘T1 Application’ ). The Tenant also applied for a reduction of the rent charged for the rental unit due to a reduction or discontinuance in services or facilities provided in respect of the rental unit or the residential complex (the ‘T3 Application’). This application was heard by videoconference on January 20, 2026.
It is ordered that: 1. The total amount the Landlord shall pay the Tenant is $27,209.69 . This amount represents: • $27,156.69 for a rent abatement from October 23, 2023, to January 20, 2026. • $53.00 for the cost of filing the application. 2. The Landlord shall pay the Tenant the full amount owing by June 1, 2026. 3. If the Landlord does not pay the Tenant the full amount owing by June 1, 2026, the Landlord will owe interest. This will be simple interest calculated from June 2, 2026 at 4.00% annually on the balance outstanding. 4. If the Landlord does not pay the Tenant the full amount owing by June 1, 2026, the Tenant may recover this amount by deducting up to 100% of the monthly rent of $ 3,366.00 (minus any applicable ongoing abatements described in paragraphs 6 through 9 below) from the rent each month until the balance owing in para graph 1 of this order is repaid. 5. The Tenant has the right, at any time, to collect the full amount owing or any balance outstanding under this order. 6. The Landlord shall offset the future monthly rent owing by a 10% rent abatement ($336.60) on an ongoing basis starting June 1, 2026, until the Tenant regains possession of the entire rental unit. 7. The Landlord shall offset the future monthly rent owing by a 7.5% rent abatement ($252.45) on an ongoing basis starting June 1, 2026, until the Landlord has stopped requiring the Tenant to manage the utilities obligations of any other parties’ agreements with the Landlord. 8.
