applied for an order determining that Frederick Hartwick and William Hartwick (the 'Landlords'): • substantially interfered with the reasonable enjoyment of the rental unit or residential complex by the Tenant or by a member of their household; harassed, obstructed, coerced, threatened or interfered with the Tenant; withheld or interfered with their vital services or care services and meals in a care home. (T2 application). • failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006 (the 'Act') or failed to comply with health, safety, housing or maintenance standards. (T6 application). This application was heard by videoconference on February 24, 2025, April 11, 2025, and June 27, 2025.
It is ordered that: 1. The total amount the Landlords shall pay the Tenants is $15,175.50. This amount represents: • $3,333.03 for a rent abatement. • $10,642.47 for the reasonable out-of-pocket expenses the Tenants have incurred. • $1,200.00 in general compensation for pain and suffering. 2. The Landlords shall pay the Tenants the full amount owing by March 31, 2026. 3. If the Landlords do not pay the Tenants the full amount owing by March 31, 2026, the Landlords will owe interest. This will be simple interest calculated from April 1, 2026 at 4.00% annually on the balance outstanding. 4. If the Landlords do not pay the Tenants the full amount owing by March 31, 2026, the Tenants may recover this amount by deducting $1,200.00 from the rent each month from April 2026 to March 2027 and $775.50 for the month of May 2027. 5. The Tenants have the right, at any time, to collect the full amount owing or any balance outstanding under this order. 6. On or before May 15, 2026, the Landlords shall: • Repair the fences surrounding the rental unit • Conduct the appropriate repairs to ensure no water is leaking into the rental unit • Conduct the recommended repairs as per the mould testing reports and ensure that the air quality is improved and that any toxic mould spores are removed from the rental unit.
