applied for an order to terminate the tenancy and evict Shivonne O'Brien (the 'Tenant') because: • the Tenant did not pay the rent that the Tenant owes (L1 Application); and • the Tenant has been persistently late in paying the Tenant's rent; (L2 Application). The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date. This application was heard by videoconference on March 4, 2026.
It is ordered that: 1. The tenancy between the Landlord and the Tenant continues if the Tenant meets the conditions set out below. 2. The Tenant shall pay to the Landlord $2,346.00 for arrears of rent, including the application filing fee up to March 31, 2026 . 3. The Tenant shall pay to the Landlord the amount set out in paragraph 2 in accordance with the following schedule: Date Amount May 20, 2026 $500.00 June 20, 2026 $500.00 July 20, 2026 $500.00 August 20, 2026 $846.00 4. The Tenant shall also pay the lawful monthly rent in full as it comes due on the 1st of the month, for the period beginning May 1, 2026 to April 30, 2028. 5. If the Tenant fails to make any one of the payments in accordance with this order, the outstanding balance of any arrears of rent and costs to be paid by the Tenant to the Landlord pursuant to paragraph 2 of this order shall become immediately due and owing and the Landlord may, without notice to the Tenants, apply to the LTB within 30 days of the Tenant’s breach pursuant to section 78 of the Residential Tenancies Act, 2006 for an order terminating the tenancy and evicting the Tenant and requiring that the Tenant pay any new arrears, NSF fees and related charges that became owing after March 31, 2026.
