applied for an order to terminate the tenancy and evict Tandie Tanner (the 'Tenant') because the Tenant, another occupant of the rental unit or someone the Tenant permitted in the building has substantially interfered with the reasonable enjoyment or lawful right, privilege or interest of the Landlord in a building that has three or fewer residential units and the Landlord resides in the building. The Landlord also applied for an order that the Tenant compensate him for out-of-pocket expenses caused by substantial interference. This application was heard by videoconference on March 23, 2026.
It is ordered that: 1. Until March 27, 2027, the Tenant shall not enter the basement unit for any purpose other than to do laundry or access storage. File Number: LTB-L-105141-25 Order Page 6 of 6 2. This order does not prohibit the Tenant from entering the basement to do laundry or access storage, but does not authorize her to enter for those purposes either. The question of whether she has the right to enter for those purposes will be decided in a different proceeding. 3. If the Tenant fails to comply with paragraph 1 of this order, the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 (the ‘Act') for an order terminating the tenancy and evicting the Tenant. The Landlord must make the application within 30 days of a breach of a condition. This application is made to the LTB without notice to the Tenant. 4. The Tenant shall pay the Landlord $186.00 for the cost of filing the application. 5. If the Tenant does not pay the Landlord the full amount owing on or before April 1, 2026, she will start to owe interest. This will be simple interest calculated from April 2, 2026 at 4.00% annually on the balance outstanding.
