applied for an order to terminate the tenancy and evict Chanel Robinson and Kevon Gayle (the 'Tenants') because: • the Tenants or another occupant of the rental unit have committed an illegal act or have carried out, or permitted someone to carry out an illegal trade, business or occupation in the rental unit or the residential complex; • the Tenants, another occupant of the rental unit or a person the Tenants permitted in the residential complex have seriously impaired the safety of any person and the act or omission occurred in the residential complex. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date. This application was heard by videoconference on February 23, 2026.

Determinations

it is ordered that: 1. The tenancy between the Landlord and the Tenants is terminated as of August 31, 2026. The Tenants must move out of the rental unit on or before August 31, 2026. 2. If the unit is not vacated on or before August 31, 2026, then starting September 1, 2026, the Landlord may file this order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced. 3. Upon receipt of this order, the Court Enforcement Office (Sheriff) is directed to give vacant possession of the unit to the Landlord on or after September 1, 2026. 4. The Tenants are entitled to move out of the rental unit earlier than August 31, 2026, as long as they provide 30 days prior notice to the Landlord. 5. From the date of the hearing, and for the remainder of the tenancy, the tenancy between the Landlord and the Tenants continues if the Tenants meet the conditions set out below: (a) The Tenants shall not commit any assaults on the residential complex, (b) While on the residential complex, the Tenants shall not attempt to contact, nor to communicate in any way with Pamela Bessette or Kimron Eyienne. 6. If the Tenants fail to comply with the conditions set out in paragraph #4 of this order, the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 (the ‘Act') for an order terminating the tenancy and evicting the Tenants.
