Dispute this orderapplied for an order to terminate the tenancy and evict ZAID ALAMIN (the 'Tenant') because the Tenant did not pay the rent that the Tenant owes. The application was scheduled to be heard by videoconference on January 15, 2026. The Landlords’ representative Shalini Puri and the Tenant Zaid Alamin engaged in private settlement discussions and advised that the parties had reached an agreement. The parties mutually agreed to resolve all matters at issue in the application and requested an order on consent. After reviewing the terms, I was satisfied that the parties understood the consequences of the order on consent. I did not determine the application on its merits.
It is ordered on consent that: 1. The Tenant shall pay to the Landlords $14,886.00 for arrears of rent up to January 31, 2026, and costs. 2. The Tenant shall pay to the Landlords the amount set out in paragraph 1 in accordance with the following schedule: a) The Tenant shall make one payment of $1,000.00 on or before February 17, 2026. b) Starting March 17, 2026, for a period of 9 consecutive months, the Tenant shall make monthly payments of $1,500.00 to the Landlords due on or before the 17th of every month. c) The Tenant shall make one last payment of $386.00 due on or before December 17, 2026. Starting on February 1, 2026, the Tenant shall pay the lawful monthly rent that becomes due while the arrears are outstanding no later than the first day of the month for which the rent is due. 4. If the Tenant fails to make any one of the payments in accordance with this order, the outstanding balance of any arrears of rent and costs to be paid by the Tenant to the Landlords pursuant to paragraph 1 of this order shall become immediately due and owing and the Landlords may, without notice to the Tenant, apply to the LTB within 30 days of the Tenant's breach pursuant to section 78 of the Act for an order terminating the tenancy and evicting the Tenant and requiring that the Tenant pay any new arrears, NSF fees and related charges that became owing after January 31, 2026.
