applied for an order to terminate the tenancy and evict Songe Destine Ngouaka Makita (the 'Tenant') and for an order to have the Tenant pay the rent they owe because the Tenant did not meet a condition specified in the order issued by the LTB on September 12, 2025, with respect to application LTB-L-104960- 24. It is ordered that: 1. Order LTB-L-104960- 24 is cancelled. 2. The tenancy between the Landlord and the Tenant is terminated. The Tenant must move out of the rental unit on or before February 15, 2026. 3. If the unit is not vacated on or before February 15, 2026, then starting February 16, 2026, the Landlord may file this order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced. 4. Upon receipt of this order, the Court Enforcement Office (Sheriff) is directed to give vacant possession of the unit to the Landlord on or after February 16, 2026. 5. The Tenant shall pay to the Landlord $12,142.88 (Less any payments made by the Tenant after this application was filed on January 21, 2026). This amount represents the rent owing up to February 4, 2026, and the cost of filing the previous application. 6. The Tenant shall also pay to the Landlord $24.72 per day for compensation for the use of the unit starting February 5, 2026, to the date the Tenant moves out of the unit. 7. If the Tenant does not pay the Landlord the full amount owing on or before February 15, 2026, the Tenant will start to owe interest.
