applied for an order to terminate the tenancy and evict the Tenant because the Tenant, another occupant of the rental unit or someone the Tenant permitted in the residential complex has substantially interfered with the reasonable enjoyment or lawful right, privilege or interest of the Landlord or another tenant (‘the L2 A pplication’) The Landlord claimed compensation for each day the Tenant remained in the unit after the termination date. The Landlord also applied for an order requiring the Tenant to pay the Landlord’ s reasonable out- of-pocket expenses that are the result of the Tenant’s failure to pay utility costs they were required to pay under the terms of the tenancy agreement. This application was heard by videoconference on May 11, 2026.
It is ordered that: 1. Pursuant to the L2 Application, the tenancy between the Landlord and the Tenant is terminated. The Tenant must move out of the rental unit on or before June 2, 2026. 2. The Tenant shall pay the Landlord any rent arrears owing up to the date of the hearing, the amount owing to the Landlord for unpaid hydro utilities and the cost of filing the application. 3. As of the date of the hearing, the Tenant owes rent arrears of $399.31 to the Landlord. 4. The Tenant shall also pay the Landlord $1,019.91 for the Landlord’ s reasonable out-of- pocket expenses that are the result of the Tenant’ s failure to pay utility costs they were required to pay under the terms of the tenancy agreement 5. The total amount the Tenant owes the Landlord for rent arrears up to May 11, 2026, plus costs incurred by the Landlord for payment of utilities, plus the cost of filing the application is $1,605.22. *See Schedule 1 for the calculation of the amount owing. 6. The Tenant shall also pay the Landlord compensation of $23.21 per day for the use of the unit starting May 12, 2026, until the date the Tenant moves out of the unit. 7. If the Tenant does not pay the Landlord the full amount owing on or before June 2, 2026, the Tenant will start to owe interest. This will be simple interest calculated from June 3, 2026 at 4.00% annually on the balance outstanding. 8. If the unit is not vacated on or before June 2, 2026, then starting June 3, 2026, the Landlord may file this order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced. 9.
