Landlord Rent A Stay Inc applied to evict Tenant Josée Villeneuve for non-payment of rent at 8, 872 County Road 17, L'Orignal, ON.
The Tenant did not attend the May 11, 2026 videoconference hearing despite proper notice, and was not responsive to the Landlord's attempts to have her join.
Rent arrears to May 31, 2026 totalled $2,490.00; lawful monthly rent is $885.00.
The Tenant paid $1,500.00 to the Landlord since the application was filed but did not meet agreed repayment terms.
Eviction was postponed to June 30, 2026 under s.83(1)(b) to allow the Tenant time to pay arrears or find alternate housing.
The Tenant may void the order by paying $2,676.00 by May 31, 2026 or $3,561.00 by June 30, 2026.
A valid N4 Notice was served and the Tenant did not void it by paying arrears by the termination date or before the application was filed.
Rent arrears to May 31, 2026 are $2,490.00; lawful rent is $885.00/month with a daily rate of $29.10.
The Tenant paid $1,500.00 since the application was filed, but arrears continued to increase.
Landlord incurred $186.00 in application filing costs, which are recoverable.
A rent deposit of $885.00 is held by the Landlord and $11.97 interest is owed to the Tenant on that deposit.
The Landlord previously attempted to negotiate a repayment agreement; the Tenant did not abide by it.
Under s.83(2), eviction was postponed to June 30, 2026 — beyond the Landlord's proposed June 10, 2026 — to allow the Tenant additional time to pay or find housing.
Extending eviction beyond June 30, 2026 was found inappropriate given limited payments and growing arrears.
Tenancy is terminated unless the Tenant voids the order by paying $2,676.00 by May 31, 2026 or $3,561.00 by June 30, 2026.
If the Tenant does not void the order, she must vacate by June 30, 2026 and owes $1,214.13 plus $29.10/day from May 12, 2026.
If the full amount is not paid by June 30, 2026, simple interest at 4.00% annually accrues from July 1, 2026.
The Landlord may file with the Court Enforcement Office (Sheriff) for enforcement starting July 1, 2026.
The eviction portion of this order expires January 1, 2027 if not filed with the Sheriff by that date.
The Tenant may make a one-time motion under s.74(11) to void the order if full payment is made before Sheriff enforcement.
