Dispute this orderapplied for an order to terminate the tenancy and evict Kimberley Ford (the 'Tenant') because the Tenant has been persistently late in paying the Tenant's rent. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date. This application was resolved by order SOL-09347-19 issued on January 29, 2020. The Tenant requested a review of the order. The request was heard by videoconference on October 22, 2021. The Board waited for more than one hour and only the Landlord’s representative David Ciobotaru attended the hearing. Witnesses for the Landlord Gwen Oldershaw and Tracy Shaw also attended.
It is ordered that: 1. The request to review order SOL-09347-19 issued on January 29, 2020 is denied. The order is confirmed and remains unchanged. 2021 CanLII 143613 (ON LTB) Order Page 2 of 2 File Number: SOL-09347-19-RV-2 2. The interim orders SOL-09347-19 issued on March 2, 2020 and SOL-09347-19 issued on September 20, 2020 are cancelled. The stay of order SOL-09347-19 is lifted. 3. The money which was paid into the Board by the Tenant, and any accumulated interest, shall be paid out to the Landlord / the Tenant. 4. The Board shall pay to the Landlord the amount of $2,069.64 together with any accrued interest. ** 5. Considering the fact the Tenant failed to attend the review hearing and the fact the Tenant has made no payments to the Landlord since the order was issued on January 29, 2020, the Sheriff is requested to expedite the enforcement of order SOL-09347- 19 issued on January 29, 2020.
