Dispute this orderapplied for an order requiring the Tenantsto pay the Landlord’s reasonable out-of-pocket costs the Landlord has incurred or will incur to repair or replace undue damage to property. The damage was caused wilfully or negligently by the Tenant, another occupant of the rental unit or someone the Tenant permitted in the residential complex. ThisL1/L2application was heardby videoconference on February 14, 2024 and March 13, 2024. The Landlord’s Legal Representative, H. Ehab Eldin Ahmed Elsayed, the Landlord, andone of the Tenants, A. Alrashaeideh(A.A.),attended the hearing.
It is ordered that: 1. The Landlord’s L2 application is withdrawn. 2. The tenancy between the Landlord and the Tenants is terminated unless the Tenants voids this order. 3. The Tenants may void this order and continue the tenancy by paying to the Landlord or to the LTB in trust: $29,886.00if the payment is made on or before March 31, 2024. See Schedule 1 for the calculation of the amount owing. OR $32,586.00 if the payment is made on or before April 6, 2024. See Schedule 1 for the calculation of the amount owing. 4. The Tenants may also make a motion at the LTB to void this order under section 74(11) of the Act, if the Tenants has paid the full amount owing as ordered plus any additional rent that became due after April 6, 2024but before the Court Enforcement Office (Sheriff) enforces the eviction. The Tenantsmay only make this motion once during the tenancy. 5. If the Tenants do not pay the amount required to void this order the Tenants must move out of the rental unit on or before April 6, 2024 6. If the Tenants do not void the order, the Tenants shall pay to the Landlord $22,811.30. This amount includes rent arrears owing up to the date of the hearing and the cost of filing the application. The rent deposit and interest the Landlord owes on the rent deposit are deducted from the amount owing by the Tenants. See Schedule 1 for the calculation of the amount owing.
