Dispute this orderapplied for an order to terminate the tenancy and evict Shannon Wharton(the 'Tenant') because the Tenant did not pay the rent that the Tenant owes. This application was heard by videoconference on March 16, 2023.
It is ordered on consent that: 1. The tenancy between the Landlord and the Tenant is terminated as of May 10 th , 2023. The Tenant must move out of the unit on or before May 10 th , 2023. File Number: LTB-L-049576-22 Order Page 2 of 2 2. The Landlord waives the full amount of rent arrears owing for the period up to March 31 st , 2023, and the filing fee, totaling $8,711.00. There is no money owed to the Landlord by the Tenant. 3. The Landlord shall pay to the Tenant $5,500.00 which shall be made on or before April 10 th , 2023. 4. If the Landlord fails to pay the Tenant as set out in subsection 3, this order shall become payable on the day following the date of default. The monies owing shall bear interest at the post-judgement interest rate as determined under subsection 207(7) of the Residential Tenancies Act, 2006. 5. If the unit is not vacated on or before May 10 th , 2023, the Tenant shall also pay the Landlord compensation of $82.19 per day for the use of the unit starting May 11 th , 2023, until the date the Tenant moves out of the unit. 6. If the unit is not vacated on or before May 10 th , 2023, then starting May 11 th , 2023, the Landlord may file this order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced. 7. Upon receipt of this order, the Court Enforcement Office (Sheriff) is directed to give vacant possession of the unit to the Landlord on or after May 11 th , 2023.
