Dispute this orderapplied for an order to terminate the tenancy and evict Ariel May Weston (AMW) and Glenn Mcclurg (GM) (the 'Tenants') and for an order to have the Tenants pay the rent they owe because the Tenants failed to meet a condition specified in the order issued by the Board on September 25, 2020 with respect to application TEL-08582-20. This application was resolved by order TEL-13660-20 issued on January 8, 2021. On January 29, 2021, the Tenant AMW requested a review of the order. The request was heard by teleconference on April 26, 2021. The Landlords’ representative M. Lalani and the Tenant AMW attended the hearing.
It is ordered that: 1. Order TEL-13660-20 issued on January 7, 2021 is cancelled and replaced by the following: 2. Order TEL-08582-20 is cancelled. 3. The tenancy between the Landlords and the Tenants is terminated. The Tenants must move out of the rental unit on or before May 31, 2021. 4. The Tenants shall pay to the Landlords $24,750.00. This amount represents the rent owing up to May 31, 2021, less the rent deposit and interest the Landlord owes on the rent deposit. 5. The Tenants shall also pay to the Landlords $57.53 per day for compensation for the use of the unit starting June 1, 2021 to the date the Tenants move out of the unit. 6. If the Tenants do not pay the Landlords the full amount owing on or before May 31, 2021, the Tenants will start to owe interest. This will be simple interest calculated from June 1, 2021 at 2.00% annually on the balance outstanding. 7. If the unit is not vacated on or before May 31, 2021, then starting June 1, 2021, the Landlords may file this order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced. 8. Upon receipt of this order, the Court Enforcement Office (Sheriff) is directed to give vacant possession of the unit to the Landlord on or after June 1, 2021. 9. This order terminates the tenancy and permits the Landlord to file the order with Court Enforcement Office (Sheriff) to evict the Tenant. However, as of the date this order is issued, the Sheriff cannot enforce this order as a result of Ontario Regulation 266/21 made under the Emergency Management and Civil Protection Act on April 8, 2021.
