Dispute this orderapplied for an order to terminate the tenancy and evict Malinda Brooks and Merlyn Brooks (the 'Tenants') because the Tenants did not pay the rent that the Tenants owe. This application was heard by videoconference on March 13, 2024.
It is ordered on consent that: 1. The tenancy between the Tenants and the Landlord is terminated. The Tenants must move out of the rental unit on or before June 30, 2024. If the unit is not vacated on or before June 30, 2024, then starting July 1, 2024, the Landlord may file this order with the Court Enforcement Office (Sheriff) so that the eviction may be enforced. 3. Upon receipt of this order, the Court Enforcement Office (Sheriff) is directed to give vacant possession of the unit to the Landlord, on or after July 1, 2024. 4. The Tenants shall pay to the Landlord $11,400.00 as follows: a) $3,800.00 on or before April 1, 2024; b) $3,800.00 on or before May 1, 2024; c) $3,800.00 on or before June 1, 2024. 5. If the Tenants fail to make any one of the payments in accordance with this order, the outstanding balance of any arrears of rent and costs to be paid by the Tenants to the Landlord pursuant to paragraph 4 of this order shall become immediately due and owing and the Landlord may, without notice to the Tenants, apply to the LTB within 30 days of the Tenant's breach pursuant to section 78 of the Act for an order terminating the tenancy and evicting the Tenant and requiring that the Tenant pay the amount owed to the Landlord. 6.
