Dispute this orderapplied for an order to terminate the tenancy and evict Richard Donoghue (the 'Tenant') because: • the Tenant did not pay the rent that the Tenant owes (L1 Application); and • the Tenants have been persistently late in paying the Tenants’ rent (L2 Application). The Landlord also applied for an order requiring the Tenant to pay the Landlord’s reasonable out- of-pocket costs that are the result of the Tenant’s failure to pay utility costs they were required to pay under the terms of the tenancy agreement. This application was heard by videoconference on December 6, 2023.
It is ordered that: 1. The tenancy between the Landlord and the Tenant is terminated as of October 4, 2023, the date the Tenant moved out of the rental unit. 2. The Tenant shall pay to the Landlord $11,962.93. This amount includes rent arrears owing up to the date the Tenant moved out of the rental unit and the cost of filing the application. The rent deposit and interest the Landlord owes on the rent deposit is deducted from the amount owing by the Tenant. 3. The Tenant shall also pay to the Landlord $1,136.94, which represents the reasonable out- of-pocket expenses the Landlord has incurred or will incur as a result of unpaid utility costs. 4. The total amount the Tenant shall pay to the Landlord is $13,099.87. See Schedule 1 for the calculation of the amount owing. 5. If the Tenant does not pay the Landlord the full amount owing on or before December 29, 2023, the Tenant will start to owe interest. This will be simple interest calculated from December 30, 2023 at 7.00% annually on the balance outstanding.
