When it applies

When can you serve an N11?

Both sides agree

You and the tenant want the tenancy to end on a specific date — any date works, mid-month included, with no minimum notice.

Negotiated exits

The N11 is the proper paper behind a "cash-for-keys" deal: the incentive goes in a side agreement, the end date goes on the N11.

Voluntary only

An N11 signed as a condition of getting the lease is void (limited student-residence exceptions). Pressuring a tenant to sign can void it too.

How the N11 process works

Agree on the terms

Pick the end date together. If money or move-out conditions are part of the deal, put them in writing alongside the N11.

Sign the N11

Prepare the move-out

Book the move-out inspection, apply the last month's rent to the final period, and settle keys and utilities for the agreed date.

If the tenant doesn't leave

Apply to the LTB on Form L3 within 30 days of the agreed termination date — no further notice is required.

What's the difference between an N11 and an N9?

The N9 is the tenant's one-way notice (60 days, period-end dates). The N11 is a two-way agreement — any date both sides accept, no minimum notice, signed by both.

Can an N11 be signed when the lease is signed?

No. An N11 signed at the start of the tenancy as a condition of renting is void, with narrow exceptions for certain student residences. It has to be a genuine, later agreement.

Is "cash for keys" legal in Ontario?

Yes — offering a tenant compensation to agree to end the tenancy is lawful and common. Do it properly: a signed N11 for the end date plus a short written agreement covering the payment and conditions.

What if the tenant changes their mind after signing an N11?

A signed N11 is binding. If the tenant doesn't move out on the agreed date, you can apply to the LTB on Form L3 within 30 days of that date for an eviction order — no notice needed.
