it is ordered that: 1. The tenancy between the Landlord and the Tenant shall continue, provided that the Tenant complies with the following conditions for a period of 12- months from the date of this order: a) The Tenant agrees to maintain the yard in a clean and sanitary condition, including but not limited to the removal of large accumulations of dog feces, garbage bags, and any derelict items. 2. If the Tenant fails to comply with the conditions set out in paragraph 1 of this order, the Landlord may apply under section 78 of the Residential Tenancies Act, 2006 (the ‘Act') for an order terminating the tenancy and evicting the Tenant. The Landlord must make the File Number: LTB-L-008019- 26 Order Page 2 of 2 application within 30 days of a breach of a condition. This application is made to the LTB without notice to the Tenant. 3. The Tenant acknowledges and agrees that the Landlord may photograph the backyard at intervals of every two (2) weeks, without prior notice, for the purpose of monitoring compliance with maintenance obligations. 4.
